Therefore, the bidder assumes full responsibility for the publication of each of the images related to the offer. finddnr.com accepts no liability to third parties if the publication of images on the site infringes the rights of third parties.

Licence to reproduce and adapt images:

The offerer grants finddnr.com an authorisation to reproduce, publicly communicate, make available, adapt and distribute the images, as well as to exercise any other rights necessary to fulfil the purpose of the contracted service. Furthermore, you acknowledge and agree that finddnr.com, if it so deems, may incorporate a code or visual identification sign in the published image, in a predefined sector, such incorporation being understood as an adaptation for all legal purposes.

Image reproduction:

Unauthorised reproduction or use of images is an infringement of copyright laws and is contrary to the best practices that finddnr.com promotes. However, it is not finddnr.com’s obligation, nor part of the service it offers, to investigate and give an opinion on the originality and authorship of an image. The offerer may report to the competent authorities and/or courts what he considers to be an unauthorised copy of a certain image, but refrains from claiming compensation or damages from finddnr.com. finddnr.com, in the interest of providing good service and promoting good practice, will remove images that it considers to be unauthorised copying as circumstances warrant, without prejudice to the seriousness of the case. In this regard, given the difficulties of classifying an image as protected or not, or as authorised or unauthorised, as well as the use of automated or semi-automated processes, finddnr.com could be confused and mistakenly remove an image with the necessary permissions for publication. The offerer acknowledges this eventuality as a risk of the service and understands that its occurrence is unintentional, which means that there is no deliberate intention on the part of finddnr.com to infringe the rights of the offerer by removing the image.

Finddnr.com’s ability to object to images:

In the event that the images to be incorporated do not correspond to the specific character of the space in which they are located; are of low quality; are general and may be representative of other products, other properties or more than one property or different project; represent objects or construction details of common use without describing the particularities of the property or its spaces; there are strong suspicions of being considered copies of other images already published; or
If any other deficiencies are found that do not conform to the defined quality standards of the site, these images may be removed from the site without prior notice. Images of projects, properties and products containing children and/or persons actually identifiable by their facial features may also be removed. It shall also be possible to delete sets of images or sequences that occupy a defined format for a single image (animated Gifs). In addition, images containing graphics with effects that could cause problems in their appreciation will be removed from the site. The bidder expressly grants finddnr.com permission to remove images containing logos, text, identification codes or other markings, or to modify such markings by graphic manipulation without prior notice or further notification, if possible. 

Publication restrictions:

Publication of plans: In relation to location plans, in the case of projects, they will always be provided by finddnr.com and cannot be replaced by others specified by the bidding user, unless finddnr.com does not have one in its possession due to the location of the project or any other reason. In the case of properties, plans will only be published as a supplementary part of the property, where the value of the information is obviously necessary, as in the case of rural land. In particular cases where the bidder may publish a plan, it must not be taken from websites or correspond to copies of plans whose reproduction is prohibited by the companies. The plans must always be authorised for dissemination and reproduction, and it is the bidder’s responsibility to obtain this authorisation. finddnr.com may remove plans when it detects that they do not have such authorisation. finddnr.com assumes no liability for third parties in the event that the publication of plans is not authorised.

Georeferencing: Using GIS (Geographic Information Systems) technology, tools provided by other free-to-use websites, or other technology developed by the site or third parties, finddnr.com may represent maps with georeferenced information about real estate projects, properties or companies located in the different communes, based on addresses or location references published in the description of the project, property or company. The location indicated for each project, property or company will be referential. From the corresponding icon, some of the information related to the publication can be accessed without the bidder having to intervene.

General posting restrictions on finddnr.com: In addition to the specific restrictions mentioned above, the following general posting restrictions apply to projects, properties and other services on finddnr.com:

Inappropriate content: You may not post content that is illegal, defamatory, obscene, violent, hateful, infringing of intellectual property rights or any other content that is against applicable laws and regulations.

False information: The publication of false, misleading or fraudulent information, including inaccurate contact details and inaccurate descriptions of projects, properties or services is prohibited.

3. Copyright and intellectual property: It is not permitted to publish content that infringes the intellectual property rights of third parties, including images, text and any other material protected by copyright.

4. Prohibited activities: It is not allowed to publish content related to illegal, fraudulent or prohibited activities by local and international laws and regulations.

5. Respect for users: Users should maintain a respectful tone and should not post content that violates the dignity, privacy or reputation of other persons or entities.

These restrictions apply to all sections and services of finddnr.com, including projects, properties, job offers, donations, grants, products and services. Finddnr.com reserves the right to remove content that does not comply with these restrictions without notice. 

Publication of Leased or Sold Properties: Under no circumstances may a project or property be published or maintained in publication that is advertised as “sold” or “leased”, or is listed as “sold out” or other reference suggesting unavailability. finddnr.com reserves the right to immediately withdraw the listing of a project, property or product which indicates a status of unavailability or which, without specifying, it is aware that the units have been sold or rented, even if they are linked to other properties, projects or products of the offeror.

Reference to Other Websites: Without explicit prior agreement as part of an ancillary service, no web address or element referring to it may be published in the offeror’s descriptive information or contact details. Specifically, the company name or any web address may not appear in the address field. If this happens, finddnr.com may choose to omit the publication of the property, project or product, remove the web address or the element referring to it, without prior notice to the bidder. Likewise, the information published by finddnr.com on the site may not be used by the provider on other sites via unauthorised links.

Dual Publication as a Used Property (Individual) and as a Project: A project or new property for sale will only be published once on the site, either as a project or as an individual property. If several units are involved, only one will be published on the site, while the rest will be removed as appropriate.

Non-Digital Extension of Publication on the Site: *Image and Basic Project Data in Print* In the case of the main image of a project, which is incorporated in the main file, the bidder declares his knowledge and acceptance that this image may also be used in complementary graphic publications, although this is not required by the site. This will be part of the publishing service on the site. finddnr.com will not require special authorisation from the bidder to publish the main image of a project or property in a listing that includes several others. At the time of contracting the service, the bidder accepts that the respective permissions or rights to publish the main image in the file can also be extended to the print media without additional requirement. If the bidder does not have the necessary permissions or wishes to waive this additional publication benefit, this should be stated at the time of contracting the service.

Free Service: The inclusion of the project in the graphic media of finddnr.com will be determined exclusively by them, without the obligation to notify or justify it to the bidder. In addition, the project’s place in the publication will be under the full control of finddnr.com, regardless of whether or not additional payment is made.

Paid Service: The bidder has the option not to purchase paid services. If you choose to do so, the conditions set out in these terms and conditions may be extended by further written agreement.

About the Data Obtained by the Bidder: *Veracity and Quality of Data Obtained* finddnr.com has no liability to the bidder for the veracity or quality of the information obtained by the bidder through the website in relation to published projects, properties or real estate products.

*The provider undertakes to maintain the confidentiality of the data of unregistered and registered users received through the services or functionalities of the website. These records should only be used for the purpose of contacting users in relation to the sale of specific project units, properties or real estate products. The offerer may not use this data to promote other properties or products. In addition, if the provider decides to follow up with these users, either on its own or through an external service, it must respect the privacy rights of the users and respect their decision not to be contacted or not to receive further communications in the future.

Use of Property Data for Statistical Information Generation: The bidder acknowledges and agrees that data provided to the site may be used by finddnr.com for statistical purposes, to generate general statistics that finddnr.com may market at its discretion. However, these statistics will not include project-specific information or information beyond *what is published on the site. In addition, statistics based on user behaviour will not be linked to personal information. The delivery of these statistics is not included in the services contracted by the bidder, unless otherwise agreed by the parties. *

Associated Products and Services: *Bidder acknowledges and agrees that finddnr.com may offer real estate, mortgage and home furnishing related products and services based on real estate information, which may include a property owned by the bidder. finddnr.com is free to include, modify or remove these offers without prior notice to the bidder and without the bidder having the option to object to their publication. In any case, the presentation of the information respects the independence of ownership and is done in a dynamic and high quality context which should be attractive to the bidder.*

Publication deadlines and conditions:

*The publication period for properties not included in a paid publication plan will be established at the time of publication, following the indications in “Publish Property”. The bidder authorises finddnr.com to extend this period without prior notice. In addition, the bidder may extend the initial deadline for a longer period by following the instructions available on the site or by e-mail notification of the end of the original deadline. Finddnr.com is not obliged to offer extensions or notify termination dates and may change the publication deadline without prior notice.

It is the sole responsibility of the bidder to be informed of the publication deadlines and to regularly check the status of the publication of his property on the site. The bidder waives any claim against finddnr.com related to the suspension of a publication.

*Exclusive criteria of finddnr.com* The use and presentation of projects in the graphic media of finddnr.com are at the sole discretion of finddnr.com, without the need for notification or justification to the bidder. The position of the project within the publication is up to finddnr.com, regardless of whether or not additional payment is made.

These records should only be used for the purpose of contacting users in relation to the sale of specific project units, properties or real estate products. The offerer may not use this data to promote other properties or products. In any case, the presentation of the information respects the independence of the property and is carried out in a dynamic and high-quality context that should be attractive to the bidder.

*Responsibility for Deadlines and Publications* It will be the sole responsibility of the bidder to inform itself about the publication deadlines and periodically review the status of publication of its property(s) on the site. The offeror waives any action of complaint or claim or of any other nature, against finddnr.com, related to the suspension of any publication, whether pre-established or not, and whether or not it has been previously notified. Likewise, bidders waive any action or complaint against finddnr.com if, on the contrary, as a result of a property(s) being published, the bidder or a third party is affected in any way by said publication. At all times, the bidder will be responsible for removing the publication of the property(s), either because it has changed
status from available to sold or leased, or for any other reason, prior to the expiration of the original term or current extension of publication. Additionally, the bidder will be responsible for verifying its elimination once the term has expired, even if its renewal has not been requested. This, taking into account the power of the site, to prolong a publication beyond the date initially indicated as the elimination date.*

Services: finddnr.com offers a variety of services to meet the needs of different users and pages:

Publication by Individuals: Includes all publication plans for individuals and their complementary services. See plans for more details.

Publishing by Owners: This service encompasses all publishing plans for property owners and their complementary services. See plans for more details.

Publication by Real Estate Projects This service covers all publication plans intended for a variety of users, including real estate professionals such as independent agents, real estate agencies, real estate project promoters, as well as individuals interested in promoting their projects. Includes specific publication plans for real estate projects and their complementary services. See plans for more details.

Restriction of Services: Users who fail to comply with the aforementioned conditions or have an outstanding debt with finddnr.com or related companies will not be able to access the services. finddnr.com reserves the right to temporarily or permanently suspend services in case of debt generated after contracting. The user will be able to access the services once the corresponding debt has been paid.

Deadline for Publication: The deadline for publishing properties and real estate projects is established by each unit and project individually, and can be renewed automatically or have a fixed term.

The options are: (a) Automatic renewal with a deadline, which starts from the plan activation date and ends on the last day of the contract according to the selected pack. (b) Fixed term, which is established from the date of activation of the plan until a date agreed between the parties.

finddnr.com will notify the offeror by email about the activation of the plan and the creation of its user, at which point the term with automatic renewal or fixed term will come into effect. The term with automatic renewal will be the default term, unless another term is specified.

Deadline for Other Services: Deadlines for services other than those mentioned above will be established as indicated in the corresponding plan contract, quote or application.

Prices: The price will correspond to that established according to the current rate for the service or the combination of them (plan) on the date of request. There are no discounts for partial use of the resources available for each service. The request to terminate the service before the end of the payment and renewal period will not give the right to reimbursement or replacement for another property or project, corresponding to the full month’s payment. Will be billed monthly per month in advance within the first 5 days of each month when necessary with current and future adaptations. In accordance with the provisions of European Law, which establishes the mandatory use of electronic invoices, the invoice will be sent to the email address registered by the offeror, or it will be published on finddnr.com. The bidder must pay the total indicated on the invoice immediately to obtain the payment benefits of the subscription. In these cases it will not be necessary to send an email with proof of payment.

Support: Although the finddnr.com tools are designed to function without assistance, in selected cases, finddnr.com will provide telephone support to the user to resolve general questions about the use or operation of the different tools available on the publishing site. According to the conditions of the requested support, this service can be free or paid, which will be previously informed to the user. In the event of a specific technical support request that, in the opinion of finddnr.com, cannot be resolved by telephone and requires in-person assistance, the user will be informed of this circumstance and the
fee associated with such service, which corresponds to finddnr.com’s regular in-person support rates. 

Conditions for Accepting Ads on FindDNR Marketplace:

1. Submission of Information: The bidder must complete and submit the listing forms with accurate and complete information about the project or property they wish to advertise on the FindDNR Marketplace.

3. Regulatory Compliance: The bidder must ensure that the publication complies with all legal regulations, including intellectual property and privacy laws.

4. Ad Approval: FindDNR reserves the right to approve or reject any proposed advertisement. Approval will be subject to compliance with platform policies and the quality of the content provided.

5. Notification of Acceptance: In the event that an advertisement is accepted, FindDNR will notify the offeror of the approval and will proceed to publish it on the platform.

By submitting a listing for review and acceptance, the bidder agrees to comply with these conditions and acknowledges that the decision to accept or reject a listing rests with FindDNR Marketplace.

Conditions for Accepting Ads on FindDNR Marketplace

The publication of projects, properties and other advertisements on FindDNR Marketplace is subject to the platform’s acceptance of the advertisements. The publication of projects or properties on FindDNR Marketplace is subject to the platform’s acceptance of the advertisements.

1. 3. System and Data Backup:– Periodic backups of the system and its data are made. However, the offerer is responsible for maintaining backup copies of its information published on the site.

4. Agreement for Companies with Multiple Projects:– In the case of bidders that manage multiple real estate projects with different services, a complementary agreement can be established that details special publication conditions for that particular bidder.

5. Communications: – Communications between the bidders and FindDNR.com will be carried out through electronic means available on the website. In cases that require more detailed communication, written means will be used, either traditional mail or email.

By submitting an advertisement for review and acceptance, the bidder agrees to comply with these conditions and acknowledges that the decision to accept or reject an advertisement remains with FindDNR Marketplace.
